There has been a wrongful death lawsuit filed with regard to a fatal pedestrian accident that happened Sunday (September 14, 2014) in Wheeling, Illinois.
This lawsuit was filed in Cook County Circuit Court by the family of accident victim Fredi Morales, 20, of Des Plaines, and names the Village of Wheeling as the defendant.
The underlying fatal pedestrian accident happened on approximately 5:45 a.m. Sunday. While details regarding the accident and its causes remain limited, the accident involved an on-duty Wheeling Police SUV striking a pedestrian as the SUV was attempting to make a traffic stop. The Wheeling Police Officer driving the SUV had not activated the SUV’s sirens, emergency lights or otherwise honked the horn prior to striking Morales.
Among other claims in the wrongful death lawsuit are claims that the SUV was traveling at “an unreasonably high rate of speed” and that the police officer was negligent for failing to activate the horn, siren and police lights in the period before striking Morales.
An autopsy that was performed Monday (September 15) by the Cook County Medical Examiner’s Office indicated that Morales died of multiple injuries suffered when he was struck by the SUV, and ruled his death an accident.
The accident remains under investigation by the Lake County Major Crash Assistance Team.
