A wrongful death lawsuit has been filed in Chicago in connection with a Christmas Eve pedestrian death in the Buckton area.
The mother of the man who was killed during that accident, Maria Lituma, filed the lawsuit Wednesday in Cook County Circuit Court, against the driver of the vehicle that struck her son, Enrique Lituma. The accident occurred at approximately 3:30 a.m. on December 24, 2011, near North Avenue and Milwaukee Avenue. The driver of the vehicle was Christine J. Ahn, 29, of Wauconda, Illinois.
An excerpt from the Chicago Sun-Times article of May 31, titled “Mother suing alleged DUI driver in fatal Christmas Eve crash” :
Ahn, 29, was initially ticketed for striking a pedestrian but was later charged with one felony count of aggravated DUI and two misdemeanor counts of DUI following the crash, police News Affairs said. Ahn is scheduled to be formally indicted June 13.
Lituma, of the 1400 block of West Augusta Boulevard, was pronounced dead about an hour after the crash at Advocate Illinois Masonic Medical Center, the Cook County Medical Examiner’s office said. An autopsy confirmed he died from multiple injuries from being struck by a vehicle and ruled his death a suicide.
The suit claims Ahn drove recklessly and had been drinking prior to the crash.
The three-count suit claims negligence, wrongful death, survival action and family expense. It seeks at least $1 million in damages, plus an unspecified amount in compensation to Lituma’s estate and surviving family members.
