In the March 7, 2015 post, titled “Three People Dead After Chicago Pedestrian Accident,” a fatal March 6 Chicago pedestrian accident involving a truck striking Elizabeth Peralta-Luna, 30, of Chicago and her two children is summarized. Chicago Police at the time of the accident cited the driver of the truck, identified as Zachary Barngrover, 23, of Iowa, with failing to yield to a pedestrian at a crosswalk as well as making an improper left turn.
Since that post a wrongful death lawsuit has been filed regarding the accident. The lawsuit was filed Monday (March 9) in Cook County Circuit Court by Peralta-Luna’s aunt, Maricela Ruiz. It names Barngrover and the Monson & Sons trucking company as defendants.
The lawsuit makes a variety of allegations. An excerpt from the March 9, 2015 Chicago Tribune article titled “Lawsuit filed against semi driver in accident that killed woman, 2 kids“:
The lawsuit claimed that when turning left from 43rd Street onto Ashland on Friday, Barngrover failed to keep a proper lookout and failed to yield and give the right-of-way to Peralta-Luna and her two kids. The lawsuit also claimed the driver was using a cellphone while driving.
Additional details and possible updates regarding this Illinois wrongful death lawsuit as well as the underlying accident can be seen in a variety of media sources, including the Chicago Tribune article mentioned above, as well as the CBS Chicago article of March 10 titled “Family Sues Driver, Trucking Company Over Accident That Killed Mom, 2 Kids.”
