As discussed in various places throughout this site, many pedestrian accidents occur in crosswalks. While, in theory, the pedestrian may have the “right of way,” in actuality many pedestrians are hit while they are rightfully crossing the street in a crosswalk “with the light.” This same issue applies to bicyclists in crosswalks. While those who are struck in crosswalks often sustain various ranges of injuries, some of these accidents lead to the death of the pedestrian or bicyclist.
One such accident happened in Champaign, Illinois in 2015. The accident injury lawsuit has recently been decided in a jury trial. The jury has awarded almost $10 million to a woman who lost her legs after being struck by a metropolitan bus in downtown Champaign in 2015.
At the time of the accident, the woman was allegedly crossing a street in a crosswalk, when she was struck by a Champaign-Urbana Mass Transit District bus. The jury trial lasted one week.
An excerpt from the sj-r.com article of August 18, 2016 titled “Jury awards nearly $10M to woman who was hit by bus“:
The Marxmillers filed the lawsuit soon after the Feb. 25, 2015 accident. The transit agency at one time contended Patricia Marxmiller walked into the side of the bus as she crossed Walnut Street in Champaign.
The August 17 The News-Gazette article, titled “Jury awards $9.85 million to bus victim, husband” further discusses the accident and the lawsuit.
