On June 15, 2016, there was a fatal bicycle accident in Chicago’s Gold Coast neighborhood. In that accident, which was summarized in the June 15 post titled “Fatal Bicycle Accident In Chicago’s Gold Coast Neighborhood” the 29-year-old bicyclist was identified as Blaine Klingenberg.
On August 2, 2016, a wrongful death lawsuit was filed in the Circuit Court of Cook County by Walter Klingenberg, father of Blaine Klingenberg.
One notable aspect of this wrongful death lawsuit is that the alleged negligence differs from that of the official Chicago Police Department accident investigation.
As stated in the Chicago Sun-Times article of August 5, 2016, titled “Father of bicyclist fatally hit on Mag Mile sues tour bus driver” the Chicago Police findings are:
Klingenberg was riding north on Michigan Avenue when he blew a red light and was hit by the bus, which was westbound on Oak, according to Chicago Police.
However, what is stated in the lawsuit alleging the fault of the accident is described as:
The suit offers a different account of the crash, alleging that the bus driver was going too fast when she disobeyed the red light and failed to keep a look out for bicyclists.
The bus driver of the double-decker bus was not ticketed or otherwise charged or cited for the accident.
Listed as defendants in the lawsuit were the driver, along with Chicago Trolley & Double Decker Company.
