Lawsuit Filed Over Fatal Illinois Car Collision

A lawsuit has been filed in connection with the death of Zachary Bingham, 18, of Maple Park, who died in a 2012 car accident.

The accident, which happened on the morning of December 1, 2012, occurred as a car collided “head-on” with the car driven by Bingham. The accident happened in Campton Hills, Illinois on Route 38.

The car that collided with Bingham’s car was driven by a woman who was fleeing police.

An excerpt from the December 3, 2013 Daily Herald article titled “Lawsuit filed in police chase that killed 2 near Campton Hills” :

The attorney for the family of Zachary Bingham, a 2012 Kaneland High School graduate, argues a Kane County Sheriff’s deputy should have called off the pursuit of Jennifer Liston, who also was killed in the crash while driving a Nissan Altima that was reported stolen out of Wheaton.

The lawsuit said Bingham “exercised due care and responsibility” by pulling his car over onto the shoulder and coming to a stop at 8:45 a.m. Dec. 1, 2012, before Liston struck his vehicle.

Liston, 30, of Madison, Wisconsin, died at the accident scene. Bingham died from his injuries on December 2, 2012.

Bingham’s girlfriend, also in Bingham’s car at the time of the accident, was injured, as well as Bingham’s dog. As well, a woman in another vehicle was injured.

At the time of the accident, witnesses say the Altima driven by Liston was traveling at speeds in excess of 100 mph, and had been involved in a hit & run accident in Geneva prior to the collision with Bingham’s vehicle.


Another excerpt, this from the Beacon-News article of December 5 titled “Lawsuit says Kane deputy’s pursuit led to fatal crash” :

In the lawsuit, attorneys for Bingham’s family suggest that Kane County Sheriff’s Deputy Nicholas Wolf should have known when to end his pursuit of Liston’s vehicle, and failed to follow proper procedures related to police chases.

Wolf “engaged a vehicle at high speeds that was reasonably known to be involved in a prior collision shortly before the (Campton Hills) collision,” the suit states.

The county and the sheriff’s office also are named in the wrongful death lawsuit. Sheriff Pat Perez, as well as the Kane County State’s Attorney’s Office, would not comment on the case because it is pending.
